The Multi
National Forces' Violations to Iraq's Sovereignty, Unacceptable Behavior

What has previously happened in the province of Diala in the city of Abi
Saida on the past month, when the foreign forces arrested a well known
politician, has been reiterated once again, but this time at the
province of Wasit, when these forces arrested an Iraqi officer with his
family after they had killed his brother and the killed brother's wife.
This incident shows another violation to the agreement of withdrawal of
the U.S. forces from Iraq once more.
The agreement that Baghdad and Washington had agreed upon its items
beforehand, represented --at that time-- a victory for the national and
popular will in realizing what the people had hoped and made every
effort to get it like the freedom, which had been the minimum possible
thing that can be gained by the son of Mesopotamia, because Iraq when
accepted this accord, it took the most important step in its history for
the sake of realizing liberty, retrieving its dignity and sovereignty,
and preserving its integrity.
In spite of all this optimism and big hopes that were set on this
agreement that is assumed to be operational on June 2009, but the thing
that raises the attention is that the foreign forces from time to time
violate this accord and do not respect the other partner's sovereignty
and its laws and judicial system, by exceeding their limited authorities
given for these forces, which include submitting the support and
logistics to the Iraqi forces without interfering in their duties and
effecting the actions of the judicial system or getting involved in the
interior Iraqi affairs.
So, these are serious infringements to the law and judiciary, whether it
was by military operations made by the multi national forces carried out
without prior notice, or without informing the Iraqi security forces
about the plans or the breaking-in and arrest operations, in addition
another faults are those when these forces shut their eyes to the rights
of the Iraqi citizen and ignore all necessary measures to preserve his
dignity and freedom untouched, moreover they directly or indirectly
endeavor to waste his rights through effacing and deforming the truths
or hiding the findings which frequently lead to forming investigative
commissions.
As usual, the response of the government is less than wanted, when it
faces a crisis or a security and military operation, decline in the
performance of the civilian and governmental institutions, nonfeasance
and deficiency in public services, outbreak and rise of administrative
and financial corruption, and plunder of the country’s wealth and its
properties, so all of these aspects in fact, are a flagrant and serious
violation to the laws, which were originally enacted to be in operation
and not to be unrespected or inoperative by cheating, because these
legislations were originally enacted for protecting the citizen’s rights
and shielding him from injustice and discrimination.
This equity and evenhandedness in granting the citizen what he deserves
or what he hopes, is of the first rights he owns in the new Iraqi
society, because the respect of the law and abidance by it does not
preserve the rights of the citizens and identifies their duties only,
but also it affirms and strengthens the confidence of the citizen in the
state and protects it, because if the state abided by the law that is
represented by the constitution of the state and respected the judiciary
system and its independence, certainly it would gain the citizen’s
confidence, because in the usual course of things, opportunities of
justice, equity and ensuring the rights are sought by applying the law.
While ignoring the law deliberately and non abiding by it, undoubtedly
it constitutes a dangerous manner weakens the structure of the new Iraqi
state, and targets the system of the reliable defense and the interior
fortification of the state, and propagates malicious ideas that aiming
at transforming the jurisprudents and judiciary into ostracized classes
by the society, consequently the thing that results in eroding of the
citizen's confidence in these institutions and in the state itself, and
in this status the jeopardy is latent, this phenomenon remembers us the
authoritarian, tyrannical practices of the defunct regime's era, because
in effect it represents an unsound conduct conflicts with the project
and concept of building the new state that respects the rights of
citizens and gets them equal in duties and rights.
Of these grave violations is what the foreign forces have committed
lastly in Wasit Province, when they arrested an officer with two of his
brothers without clarifying the reasons of the arrest, moreover they
killed a bystander near the scene and killed the brother of the officer
and his wife and scattered and devastated the contents of the house.
This operation of arrest besides it’s accompanied events are clear
violations to the rights of the Iraqi citizen, the thing that raised
many questions concerning the reality of the status of the foreign
forces in Iraq, the signed agreement between the two country, the
feasibility of it and whether abiding by its provisions or ignoring it,
the failure in putting its items into effect and applying its schedules,
and non respect for the signed memorandums and covenants between the two
country, which state that the withdrawal from the cities completely, the
security file is the job of the Iraqi security forces, non intervening
in the country's interior affair, the arresting and breaking-in
operations are the job of Iraqi security forces not of the foreign
forces, and identifying the mechanism that is assumed to be practiced in
the new Iraq, the Iraq of Constitution and law.
